Pensions

Read our latest pensions newsletter - February 2008

Now rarely out of the news, pensions have been changed and “simplified” so often that the situation has become increasingly concerning for all. Pensions are complex and costly and are now clearly linked to the health and prosperity of employers. The Pensions Act 2004 and the Finance Act 2004 are bringing fresh challenges.

The Biggart Baillie Pensions Team keeps up-to-date with the constant stream of regulations, guidance and bulletins which all bring about adjustments.  Experiences, developments in law cases, changes in practice and results are shared amongst team members to improve the quality of work for and with our clients.  As lawyers we work with scheme actuaries, auditors, investment advisers, bankers, insolvency practitioners and pension consultants.

What we do...

What we offer is practical, informed and commercial advice for our corporate clients which can be used as a basis for taking decisions. Our services include:

  • Advice on pensions law and practice, including Inland Revenue practice.
  • Corporate Services: sales, purchases, mergers, review of pension arrangements, including rights and liabilities.
  • Deeds and other documentation.
  • Effective communications.
  • Corporate Insolvency.
  • Trustee Services.
  • Personal Insolvency.
  • Pensions on Divorce.
  • Opinions on pensions law and practice for lawyers and other professionals.
  • Disputes: internal dispute resolution procedure, Pensions Ombudsman, Regulatory Authorities and Court actions.
  • Training.

There is a lot at stake and we never forget that. Many employers have been reviewing their pension schemes over the last few years. Many defined benefit or final salary schemes are continuing and many employers and trustees have come up with a variety of ways to tackle the challenges currently facing these schemes.

Current appointments for the team include: the Blyth and Blyth Pension Scheme, Morrison Bowmore Distillers Pension Fund, Standard Life Staff Pension Scheme and The Law Society of Scotland Staff Retirement Benefits Scheme.
