Public procurement law is aimed at promoting the free movement of goods and services within the EU, ensuring competition between suppliers and preventing discrimination and the favouring of national suppliers by member states.
Public bodies and utilities have long been required under EU law to put contracts for goods, works and services out to public tender in accordance with the applicable procurement rules and non compliance can have serious commercial consequences.
Compliance with procurement law has become increasingly important in recent years, particularly in light of the current economic climate. Suppliers are becoming more aware of their rights and remedies under the rules (which have recently been significantly improved as a result of the Remedies Directives) and are now more willing to challenge a contract award decision.
