Corporate Manslaughter and Corporate Homicide Act 2007 - If the management of a Corporation, or some other designated body, breaches a duty of care which results in death, they could be found liable for the new offence of corporate manslaughter.
- Sex Discrimination Act 1975 (Amendment) Regulations SI 2008/656 - the main changes made to the Sex Discrimination Act, under the Regulations, are:
the definition of sexual harassment;
the definition of discrimination on grounds of pregnancy or maternity leave;
the exceptions applicable to claims of discrimination on grounds of maternity leave;
they make it unlawful for an employer to fail to take reasonably practicable steps to protect an employee from persistent third party harassment where the employer has knowledge of such harassment.
Social Security Benefits Up-rating Order 2008 SI 2008/632 - statutory maternity, paternity and adoption pay is increased from £112.75 to £117.18 per week. Statutory sick pay is increased from £72.55 to £75.40.
Information and Consultation of Employees Regulations 2004 SI 2004/3426 - the right for employees to agree procedures for informing and consulting on workplace issues, and/or business matters which effect their employment, with their employer is extended to undertakings with 50 or more employees (previously undertakings with 100 or more employees).
Income Tax (Pay as You Earn) Regulations 2008 SI 2008/782 - the Regulations make a number of changes relative to collecting income tax through the PAYE system. One of the most important changes is that there will be no double recovery of tax where a self-employed person has paid schedule D tax on earnings paid gross by his "employer" but is then found to be an employee. HMRC had been able to recover undeducted schedule E tax from the employer without giving credit to the workers payment under schedule D. The Regulations also grant HMRC a power to transfer PAYE liability from an employer to an employee.
