Consultation begins on new ACAS code of practice

Under the Employment Bill which is due to come into force in April 2009, the statutory minimum requirements for disciplinary and grievance procedures will be removed.  The emphasis will be much more on ensuring that employers comply with the codes of practice published by ACAS.  Failure to do so could see an uplift in compensation of up to 25%.

Thus far, there has been little progress regarding the Employment Bill.  However, in light of the changes in the law, ACAS are revising their code of practice on discipline and grievance.  This has now been published and is open for public consultation.  The decision to shorten the code was influenced by the fact that many responses to the government consultation (the Gibbon's Review) called for a shorter, more principle-based code.

We will update you on further developments regarding the new code.
